The on-site investigation began half an hour after the commission of the attempted murder. So, the criminal investigation bodies reached the scene immediately, where the traces of the incident were unaltered. At the scene there were also three “eco” agents (Leordean Vasile, Sălăşan Luca, Leordean Sara) and four locals (Coman Nelu, Coman Neluțu, Lascu Cornel, and Vinţonescu Gabriel). All had been eyewitnesses of the crime and had fresh in their minds the image of what had happened. They were all sincere in those moments and presented exactly the unfolding of the events (video 10.1).
The Witnesses Confirm the Cruelty of the Deed.
The testimony from the footage recorded by the gendarmes who were the first to reach the scene illustrates the state in which all those who had witnessed the attempted murder committed against me found themselves. The facts were clear (video 10.2). Statement of Coman Alin Ștefan: “Bocea Mihalache tried to talk with the driver of the Hyundai car, namely with Andrioni Alin. Bocea Mihalache positioned himself to the lateral right of the Hyundai. At the moment when Bocea Mihalache approached, the driver of the Hyundai car, about whom I found out that his name is Andrioni Alin, set off, swerved right, skidded, took Bocea Mihalache onto the hood, and drove with the right front wheel over Bocea Mihalache. The Hyundai continued to move toward the village. At the moment when the Hyundai set off, Bocea Mihalache put his hands on the hood of the car in order to protect himself”(doc.1).
The Only “Real” Investigation
From the on-site investigation report it results that each of those present indicated: “with precision, the place from where Andrioni Alin set off with the car, its route, the place where he hit me, and the distance to where he dragged me under the car, after which he fled.” The criminal investigation bodies drew up the general sketch of the scene on the basis of the witnesses’ statements and the traces existing on the ground (doc.2). Looking at this sketch and the photo plates, we can see that I left from next to Leordean Vasile toward the car driven by Andrioni. At the moment when I reached the level of the right front wheel, the car suddenly swerved toward me, cutting off my path. In photo plate no. 26, drawn up by the forensic police, the front wheels can be seen turned to the maximum to the right (doc.3). The first instinct was to retreat 2-3 steps, but I did not manage to get out of the car’s path because the driver accelerated at that moment and took me onto the hood. The witnesses’ statements and the measurements made after the traces at the scene confirm that I was taken onto the hood and dragged with my feet on the ground for a distance of 7.20 meters, after which I was pushed and rolled under the car for a distance of 6 meters.
From the Provocation of Violence to the Attempted Murder
From the images filmed by Andrioni Alin, it can be seen that, at the moment when I got out of the ATV, Leordean came toward me in a boxer’s stance. Seeing that I am being provoked to violence, I put my palms over his hands and passed on by him. I reached the right side of the car, which was moving at a very low speed (2-3 km/h), and I noticed that the driver and the person on the right were ostentatiously filming us. It seemed suspicious to me that the driver had the hood of his sweatshirt pulled over his head. Why camouflage yourself under a hood on a sunny summer day, being inside the car? Naturally, I wanted to see who the persons filming on our property were, so I continued to walk alongside the jeep with tinted windows in the back. When I reached the level of the right front wheel, the driver suddenly swerved toward me. Out of fear of being hit, I retreated a few steps back and ended up in front of the car. When Andrioni realized that I had seen his face, he accelerated and took me onto the car’s hood. I managed to grab the car’s bullbar with my hands and held on as much as I could to save myself. I did not manage, however, to lift my feet off the ground, and I was pulled under the car. The driver did not brake at all, continued to accelerate, and fled the scene.
From the footage and photographs taken at the scene, which are evidence in the file, it can be seen that there were no obstacles in the area, and the visibility was very good. The driver, if he had had the slightest intention to avoid me, could have driven off my land straight ahead onto the communal road, or could have turned left, leaving unhindered. He, however, chose to swerve toward me and did not brake at any moment. The criminal investigation bodies found no braking traces at the scene. Moreover, those who were accompanying me and Weidinger Gerit – from inside the car – shouted at the driver to stop before he drove the car over me. A fact confirmed by the forensic police, in the report drawn up on the occasion of the examination of the film made by Weidinger Gerit (photo plates no. 30 and 31): “Bocea Mihalache was on the left-front part of the Hyundai Galloper car, leaning over the hood, during which time in the car the voice of the named Weidinger Gerit is heard: Oh!!! The car continues to roll, and while it is observed how the named Bocea Mihalache is still on this part of the car, at the corner of the hood on the left-front part (in front of the driver), the named Weidinger Gerit has the following verbal reaction: “Shit! (translator’s note: “La dracu”)…Shit, shit (t.n.: “La dracu! La dracu!”)…haaa! Oh my God! Oh my God! Oh my God! (t.n.: “Dumnezeule! Dumnezeule! Dumnezeule!”)… Oh my God! (t.n.: “Dumnezeule!”)…(doc.3).Therefore, the criminal cannot invoke the fact that he did not see me on the hood of the car and that he did not hear the cries of desperation around him. Likewise, he cannot say that he did not see when he pushed me under the car or that he did not feel when he drove over me, given that from the images it can be seen that there were no holes or bumps in the area.
Evidence That Andrioni Drove the Car Over Me
The wheels of the vehicle driven by the criminal left traces on the clothes I was wearing on the day of the attempted murder. They are indubitable proofs showing that Andrioni drove the car over me. By the order of the case prosecutor, issued on 24.05.2015, it was ordered “the handing over of the items of clothing worn by Bocea Mihalache during the commission of the attempted murder”. The forensic police recorded the proof of the handing over of the objects and drew up the photo plate with judicial photographs, after which they recorded in a report what they had found (doc.4). From here we find out that: “Photo no. 1-2: Represents the khaki-colored vest of tercot-type material, with the inscription on the inner side “Blaser,” which presents cutting traces along its entire length in the upper part, in the areas corresponding to the shoulders, with soil traces in the lower-right part, where such a trace is observed, with a width of about 18 cm, oriented obliquely, in the direction of the zippered pocket, more pronounced on the surface from the edge of the vest to this pocket, continuing up to the area corresponding under the arm. This trace has a specific character of pressing-folding”. Likewise, on the t-shirt there appear traces of a reddish-brown substance and traces of vegetation, and the appearance of these traces is specific to pressing-folding (photo 3-4). Likewise, in photo 5 the trousers present soil traces, the relevant ones being the traces on the lateral-exterior part of the right leg, with the appearance of pressing-folding”.
Moreover, none of those at the scene contested the way in which I was crushed under the wheels of the vehicle driven by Andrioni. Even the criminal’s companions showed “with precision” the details of the crime: “we asked the named Coman Nelu, Lascu Cornel, Vițonescu Petru Gabriel, Coman Nelu jr, Leordean Vasile Ioan, Sălăşan Luca, and Leordean Sara Mădălina to indicate to us the place where the car driven by the named Andrioni Alin Constantin was stopped, the place where the named Bocea Mihalache was hit, as well as the place up to which the victim was dragged under the car. The persons mentioned above agreed to this activity and indicated with precision what was requested”, it is stated in the on-site investigation report. At the end, the document is assumed by signature by all: “The parties present have no objections regarding the way in which the finding was made, nor regarding what was recorded above” (doc.5). Subsequently, Andrioni and a few “experts” claimed that I was not crushed under the wheels of the vehicle, but the imprint of the tires on my clothes cannot be erased with theories and lies. The proof remained and is obvious to anyone, except for those who worked on covering up the attempted murder.
The on-site investigation was the only moment in which the inquiry was carried out correctly, with honesty. Shortly afterward, it seems that the criminal investigation bodies received the order to “whitewash” the criminal, because the data collected at the scene were deliberately misinterpreted.
