The on-site investigation began half an hour after the attempted murder took place. Thus, the criminal investigation authorities arrived at the scene promptly, where the traces of the incident were still intact. At the crime scene, there were still three “eco” agents (Leordean Vasile, Sălăşan Luca, Leordean Sara) and four locals (Coman Nelu, Coman Neluțu, Lascu Cornel, and Vinţonescu Gabriel). All of them were eyewitnesses to the crime and still had a fresh memory of what had just occurred. All were sincere in those moments and presented the exact sequence of events as it happened (video 10.1).
Witnesses confirm the cruelty of the act.
The testimony captured in the footage recorded by the gendarmes who were the first to arrive at the scene illustrates the state in which all those who witnessed the attempted murder against me found themselves. The facts were clear (video 10.2). Statement by Coman Alin Ștefan:
“Bocea Mihalache tried to speak with the driver of the Hyundai vehicle, namely Andrioni Alin. Bocea Mihalache positioned himself to the right side of the Hyundai. As Bocea Mihalache approached, the driver of the Hyundai, whom we later learned is Andrioni Alin, pulled away, turned to the right, skidded, hit Bocea Mihalache with the vehicle, and drove over him with the right front wheel. The Hyundai then continued driving toward the village. At the moment the Hyundai pulled away, Bocea Mihalache placed his hands on the car’s hood to protect himself” (doc.1).
The only investigation done “by the book”
From the official on-site investigation report, it results that each person present indicated “precisely the location where Andrioni Alin started driving, the path of the vehicle, the spot where I was hit, and the distance over which I was dragged under the car, before it fled.” The criminal investigation authorities drew the general sketch of the crime scene based on the witness statements and the traces found on the ground (doc.2). Looking at this sketch and the photographic plates, one can see that I moved away from Leordean Vasile toward the vehicle driven by Andrioni. At the moment I reached the front-right wheel of the vehicle, it suddenly turned toward me, cutting me off. In photo plate no. 26, drawn up by the forensic police, the front wheels can be clearly seen turned sharply to the right (doc.3). My first instinct was to step back 2–3 steps, but I couldn’t avoid the car’s path because the driver accelerated at that exact moment and picked me up onto the hood. The statements of witnesses and the measurements made based on traces at the scene confirm that I was taken onto the hood and dragged with my feet on the ground for 7.20 meters, then pulled and rolled under the car for another 6 meters.
From the videos and photographs taken at the scene—which are part of the evidence in the case—it is clear that there were no obstacles in the area and visibility was excellent. The driver, if he had even the slightest intention of avoiding me, could have driven straight ahead onto the communal road or turned left and left freely. Instead, he chose to turn toward me and never braked. The investigation authorities found no brake marks at the scene. Moreover, those who were with me and Weidinger Gerit (from inside the car) shouted at the driver to stop before he ran over me with the vehicle. This fact is confirmed by the forensic officers in the official report made after examining the video recorded by Weidinger Gerit (photo plates no. 30 and 31):
“Bocea Mihalache is seen on the left-front side of the Hyundai Galloper, leaning over the hood, while inside the vehicle the voice of Weidinger Gerit can be heard: ‘Oh!!!’ The vehicle continues to move forward, and while Bocea Mihalache is still on the hood, at the front-left corner (in front of the driver), Weidinger Gerit verbally reacts: ‘Shit! Shit, shit… huh! Oh my God! Oh my God! Oh my God! Oh my God!’” (doc.3).
Therefore, the perpetrator cannot claim he didn’t see me on the hood or didn’t hear the desperate cries around him. Similarly, he cannot say he didn’t see when I was dragged under the vehicle or that he didn’t feel when he ran over me, given that the footage clearly shows there were no potholes or bumps in the area.
Evidence that Andrioni ran over me with his vehicle
The wheels of the SUV driven by the perpetrator left traces on the clothing I wore the day of the attempted murder. These are indisputable pieces of evidence that show Andrioni ran over me with his vehicle. By order of the case prosecutor, issued on 24.05.2015, it was mandated that “the clothing worn by Bocea Mihalache at the time of the attempted murder be handed over.” The forensic police recorded the receipt of these items and made photographic records, then documented their findings in an official report (doc.4).
From this we learn:
“Photo nos. 1–2: Shows a khaki vest made of tercot material, labeled on the inside ‘Blaser’, which has cuts along the upper shoulder area, and soil traces on the lower-right part, where a mark with a width of about 18 cm is visible, angled in the direction of the zippered pocket, more pronounced from the edge of the vest up to this pocket, continuing under the armpit. This mark has a characteristic of pressure-folding.”
Additionally, on the shirt there are traces of a brownish-red substance and vegetation, and the marks suggest pressure-folding (photos 3–4). Similarly, in photo 5 the pants show soil marks, particularly notable on the outer side of the right leg, again consistent with pressure-folding.
Furthermore, no one present at the scene disputed how I was crushed under the wheels of the SUV driven by Andrioni. Even the companions of the perpetrator provided precise details of the crime:
“We requested the following individuals: Coman Nelu, Lascu Cornel, Vițonescu Petru Gabriel, Coman Nelu jr, Leordean Vasile Ioan, Sălăşan Luca, and Leordean Sara Mădălina to indicate the location where the vehicle driven by Andrioni Alin Constantin was stopped, where Bocea Mihalache was hit, and where the victim was dragged under the vehicle. The individuals mentioned above agreed to this activity and precisely indicated the requested locations,” the on-site investigation report states. At the end, the report was signed by all:
“The present parties have no objections regarding the manner in which the observations were made, nor regarding the statements noted above” (doc.5).
Later, Andrioni and several “experts” claimed that I was not run over by the SUV’s wheels, but the tire imprint on my clothing cannot be erased by theories and lies. The evidence remains and is obvious to anyone, except those who worked to cover up the attempted murder.
The on-site investigation was the only moment in which the investigation was conducted properly, with integrity. Soon after, it seems that the criminal investigation authorities received the order to “whitewash” the perpetrator, because the data collected at the crime scene was later deliberately misinterpreted.
